  • Sensex up 104 pts in early trade, Oil lists at 7% premium
    The Bombay Stock Exchange benchmark Sensex shot up by nearly 104 points in early trade on Wednesday on higher capital inflows from foreign funds even as global markets were under pressure.

    Also, shares of Oil India which were listed on the bourses today attracted over 7 per cent premium at Rs 1,127 against the offered price of Rs 1,050.



    The 30-share BSE Sensex rose by 103.69 points to 16,956.60 points in opening trade with oil and gas, IT, metals and auto sector stocks leading the rally. The BSE barometer had gained 159.91 points in Tuesday's trading.

    Similarly, the wide-based National Stock Exchange index Nifty moved up by 23.40 points to 5,029.25.

    Stock brokers said sustained buying by both foreign and domestic funds mainly bolstered the trading sentiment but gains were restricted following overnight losses on the US markets and weak trend in other Asian markets.

    The other major gainers were Reliance Industries by 0.37 per cent to Rs 2,174.10, ONGC by 0.59 per cent to Rs 1,193.20, Infosys Technologies by 0.47 per cent to Rs 2,298.50, TCS by

    1.06 per cent to Rs 616.90, Sterlite Industries by 0.97 per cent to Rs 756.70 and Rcom by 0.35 per cent to Rs 300.80.

    In the international market, the US Dow Jones Industrial Average closed 0.48 per cent down in Tuesday's trading, while today in the morning Hong Kong's Hang Seng Index fell by

    0.55 per cent and Japan's Nikkei was down by 0.65 per cent.

    In case of dog bite wash the wound liberally with water and soap and take the person to the nearest Delhi Government Hospital for treatment of the wound. Rabies vaccination is available free at all Delhi Government hospitals.

    Snake Bite
    Snake bite is an emergency and the person bitten should be tken immediately to the hospital. Treatment for Snakebite is available free in all Delhi Government hospitals.

    Unconsciousness

    Any type of unconsciousness is a medical emergency and requires immediate medical care. The unconsciousness may be a result of Injury or trauma, or poisoning or other diseases like cerebrovascular accidents, hypertension, diabetes mellitus etc.

    In case of unconsciousness, take the patient to any of the nearby hospitals where emergency services are available.

  • Symptoms of Influenza A (H1N1) Swine Flu
    Influenza A (H1N1) is an influenza virus, which has been reported as a cause of illness and death in people. It was earlier known as Swine Flu. Originating in Mexico in April 2009, the virus has since spread to many countries worldwide. Early laboratory testing showed that many genes in this virus were similar to those found in pigs of North America, which is why the illness was originally called Swine Flu. Later on, further tests proved that this virus has gene segments from the swine, avian and human flu virus genes. This led scientists to discard the previous name and rename the virus the 'Influenza-A (H1N1) Virus'.

    The symptoms of Influenza A (H1N1) are similar to the symptoms of regular seasonal flu. People who have this illness may experience fever, cough, sore throat, body aches, headache, chills and fatigue. Some patients have also reported diarrhoea and vomiting.

    The flu virus is thought to spread from person to person through droplets that come out of an infected person's nose or mouth when he/she sneezes or coughs. Pigs have nothing to do with this disease. Pork products are absolutely safe if properly cooked and culling of pigs is not needed.

    Commons Precautions

    Here are some precautions to prevent contraction of the virus -

    1. Cover your nose and mouth with a tissue when you cough or sneeze. Discard the tissue after use.
    2. Wash your hands thoroughly after you cough or sneeze.
    3. Avoid touching your eyes, nose or mouth as germs may spread this way.
    4. Stay away from close contact with people having respiratory illnesses.
    5. If one displays influenza like symptoms, one must limit contact with others by staying at home. However, in case of respiratory distress, one should visit a nearby hospital without delay.
    6. Take care of your health. Get plenty of sleep, exercise regularly, manage stress, drink plenty of liquids and eat wholesome food.

    Prevention of Flu Conditions

    The Department of Ayurveda, Yoga and Naturopathy, Unani, Siddha and Homeopathy (AYUSH) (External website that opens in a new window) is concerned about the growing number of H1N1 virus cases being reported from various parts of the country. It is of the view that Ayurveda / Unani interventions can be used for improving a person's immunity to fight various flu like conditions. These measures can be adopted by normal healthy people as well as those who have mild cold, cough and body pain.

    The Department of AYUSH set up a group of experts for suggesting AYUSH interventions which are helpful in the prevention / treatment of flu like diseases. Ayurvedic specialists have advised certain measures such as avoidance of 'Kapha' food items like curd, cold drinks, fruit juices, ice cream; drinking of hot water in place of cold water and use of decoctions made up of herbs such as tulsi, ginger, black pepper and guduchi in the morning.

    The Central Council for Research in Unani Medicine (CCRUM) (External website that opens in a new window) also had a detailed consultation with Unani experts and recommended certain preventive measures such as use of decoctions, tea, arq, specific compound formulations, local application of particular 'Roghans' as well as suggesting a light diet and maintenance of personal hygiene.

    Flu like illnesses may also be prevented through Homeopathy. The Central Council for Research in Homeopathy (External website that opens in a new window) (CCRH) has recommended a homeopathic medicine (External website that opens in a new window) for protection against such flu like conditions.

    However, in cases where people develop severe symptoms (Category B and C) (External website that opens in a new window), they are advised to visit the designated screening centres /hospitals set up by the Central and State Governments for the purpose. Medicines for the treatment of this illness are available in India. The Government has procured and stored the necessary drugs in sufficient quantities at designated hospitals. Citizens are strongly advised against procuring and taking medicines on their own, as it will lower their immunity.

    The Government has also created a strategy to detect Influenza A (H1N1) cases among passengers arriving from affected countries either by air, land or sea and quarantine them. A standard process for screening, testing and treatment will be used across the country. If you have travelled from any of the affected countries in the past 10 days and display the symptoms of Influenza A (H1N1), then kindly visit a nearby hospital.

    On 12th August, 2009 Hon'ble Finance Minister Shri Pranab Mukherjee released the Draft Direct Taxes Code - External website that opens in a new window for public debate. The Code envisages promoting voluntary tax compliance and an equitable and progressive tax regime by eliminating distortions in the tax structure, introducing moderate levels of taxation, expanding the tax base and simplifying the drafting language. Based on the inputs from the public, the Government will finalize the Draft Taxes Code Bill for presentation in the winter session of Parliament, 2009. The new law is proposed to be effective from 1st April, 2011.
    Salient Features of the Code

    The Code seeks to consolidate and amend the law relating to all direct taxes, that is, income-tax, dividend distribution tax, fringe benefit tax and wealth-tax so as to establish an economically efficient, effective and equitable direct tax system which will facilitate voluntary compliance and help increase the tax-Gross Domestic Product (GDP) ratio. Another objective is to reduce the scope for disputes and minimize litigation.

    Briefly, the salient features of the Code are as under:-

    * Single Code for direct taxes: All the direct taxes have been brought under a single Code and compliance procedures unified. This will eventually pave the way for a single unified taxpayer reporting system.
    * Use of simple language: With the expansion of the economy, the number of taxpayers can be expected to increase significantly. The bulk of these taxpayers will be small paying moderate amounts of tax. Therefore, it is necessary to keep the cost of compliance low by facilitating voluntary compliance by them. This is sought to be achieved, inter alia, by using simple language in drafting so as to convey, with clarity, the intent, scope and amplitude of the provision of law. Each sub-section is a short sentence intended to convey only one point. All directions and mandates, to the extent possible, have been conveyed in active voice. Similarly, the provisos and explanations have been eliminated since they are incomprehensible to non-experts. The various conditions embedded in a provision have also been nested. More importantly, keeping in view the fact that a tax law is essentially a commercial law, extensive use of formulae and tables has been made.
    * Reducing the scope for litigation: Wherever possible, an attempt has been made to avoid ambiguity in the provisions that invariably give rise to rival interpretations. The objective is that the tax administrator and the tax payer are ad idem on the provisions of the law and the assessment results in a finality to the tax liability of the tax payer. To further this objective, power has also been delegated to the Central Government/Board to avoid protracted litigation on procedural issues.
    * Flexibility: The structure of the statute has been developed in a manner which is capable of accommodating the changes in the structure of a growing economy without resorting to frequent amendments. Therefore, to the extent possible, the essential and general principles have been reflected in the statute and the matters of detail are contained in the rules/Schedules.
    * To ensure that the law can be reflected in a Form: For most taxpayers, particularly the small and marginal category, the tax law is what is reflected in the Form. Therefore, the A-10 structure of the tax law has been designed so that it is capable of being logically reproduced in a Form.
    * Consolidation of provisions: In order to enable a better understanding of tax legislation, provisions relating to definitions, incentives, procedure and rates of taxes have been consolidated. Further, the various provisions have also been rearranged to make it consistent with the general scheme of the Act.
    * Elimination of regulatory functions: Traditionally, the taxing statute has also been used as a regulatory tool. However, with regulatory authorities being established in various sectors of the economy, the regulatory function of the taxing statute has been withdrawn. This has significantly contributed to the simplification exercise.
    * Providing stability: At present, the rates of taxes are stipulated in the Finance Act of the relevant year. Therefore, there is a certain degree of uncertainty and instability in the prevailing rates of taxes. Under the Code, all rates of taxes are proposed to be prescribed in the First to the Fourth Schedule to the Code itself thereby obviating the need for an annual Finance Bill. The changes in the rates, if any, will be done through appropriate amendments to the Schedule brought before Parliament in the form of an Amendment Bill.

  • SC relief for IPS officer
    The Supreme Court on Wednesday ordered that observations made by the high court against IPS officer Meeran Borwankar in the Asha Bajaj case be expunged from records.

    A division bench of Justice D K Jain and Justice H L Dattu observed that the high court should have refrained from making adverse comments on the conduct of Borwankar for `allegedly' misusing her official position.

    The IPS officer had approached SC, challenging the HC order where she was pulled up for sending Bajaj to a mental asylum in Pune. The case dates back to 2007 when Borwankar ordered her officers to arrest Asha Bajaj and send her to a mental asylum in Pune. According to the police, Bajaj had been harassing Borwankar by sending SMSes saying that she liked her son.

    The SC said that if the letters and the SMSes placed on record were true, it could have been a reason for anyone to feel harassed and embarrassed.

    In its order, the HC bench of Justice Bilal Nazki and A A Kumbhakoni had remarked that Borwankar seemed to have had some "grudge'' against Bajaj. "The whole exercise was done to send Bajaj to a mental hospital with a preconceived plan in which the main role has been played by Borwankar and unfortunately by the magistrate,'' the HC had observed. "If Borwankar had any grievance, she could have taken recourse to the law and Bajaj could have been booked for offences she might have committed. But the course taken by Borwankar was absolutely wrong and was not expected of an officer of (her) cadre.''

    As communicated vide this Department's Resolution N0.I/I/2008-IC dated 29th August, 2008, the Government had decided that the arrears on account of implementation of Sixth Central Pay Commission's recommendations will be paid in cash in two instalments - first instalment of 40% during the year 2008-09 an^tne remaining 60% in the financial year 2009-10. The first instalment has already been paid in 2008-09. It has now been decided that the remaining 60% of arrears may now be paid to the concerned Government servants.
    2. Further, as already stipulated vide this Department's O.M. No 1 (2)/ EV/2008 dated 17th August, 2009, in the case of post - ol.01.2004 entrants into the Central Government, the second instalment of arrears may be released only after individual application forms for registration to the New Pension Scheme have been obtained by the DDO/ PAO from the concerned Government servant.

    3- As in the case of the first instalment of arrears, Government servants will be permitted to deposit their arrears in their GPF Accounts. Though not mandated, Government servants are encouraged to deposit their arrears in their GPF accounts.

  • Govt to review IIT faculty pay
    With faculty from across the Indian Institutes of Technology (IIT) calling off lectures and threatening dire consequences like mass resignation, the Centre has sat up and promised to revisit the pay structure it formulated for IIT teachers.

    On Friday, HRD minister Kapil Sibal said his officials would take a look at the salary offered to faculty and rework the pay structure if need be.

    Sibal said the problem was that though at the entry level, IIT teachers get more salary, selection for the next promotion, unlike the UGC system where it is automatic, results in disparity. “We will look into it,” he said.
    On their part, IIT professors continued their protest.

    At IITMadras, faculty stayed away from classes on Friday and IIT-Bombay teachers refused to conduct lectures on Monday. The Union government recently announced pay scales for faculty at centrally-funded technical institutes but declared a salary structure lower than what was recommended by the Govardhan Mehta Committee, set up to decide pay scales for staff at central institutes.

    “The pay scales are almost as much as the UGC scales. For us, equal measure is laid on our academic duties and research work. The government has not taken the hard work we put in into consideration,” said Soumyo Mukherji, secretary of the faculty forum at IIT-B.

    For instance, whether a professor is employed in a state university or at the IITs, he/she is place in pay band 4, which ranges from Rs 37,400 to Rs 67,000, the only difference being that of the academic grade pay (AGP), on lines with grade pay for government employees.

    While AGP for state university professors recommended by the UGC stands at Rs 10,000, the same is Rs 10,500 for those in IIT. “We are competing against American universities to attract talent. With such pay scales, we cannot expect any top rate teacher to join the IITs,” said S Bhat, president of the faculty forum.

    The IITs had demanded that faculty members be given an incentive for research as well as for upgrading their professional skills, but the final announcement omitted all these recommendations.

  • Pune Municipal Corporation (PMC) special panel okays ' Sixth Pay' for all employees
    A special committee appointed to take decisions regarding the implementation of the Sixth Pay Commission for the employees of Pune Municipal Corporation (PMC), on Friday gave approval to give the benefits to all the civic employees at PMC. The decision will now come up before the general body for the final approval.
    The committee has given nine recommendations for the implementation of the sixth pay commission and decided to give the benefits to all the PMC officials and employees.

    The committee also said that if necessary funds are not available, they should be made available in the budget. As per the standing committee decision regarding this, Rs 15,000 advance should be given to the employees. The committee has also said that as per the state government directions, the dues should be paid to the employees in five installments. The first installment should be given in 2010-11. The first installment would directly be paid at the provident fund.

    The committee has given following recommendations. As per the municipal commissioner’s report, the salary hike should be 40 per cent in addition to the maximum salary amount. The 40 per cent grade pay should be as per the pay scale. The report has also suggested 1.5 per cent hike in the allowances, which the committee decided to hike by another 0.5 per cent.

    The revised pay scale after the implementation of Sixth Pay should be hiked to Rs 15,600 to Rs 39,100. The revised pay-scale for city engineer and health chief should be Rs 34,000 to Rs 67,000 as per Pay Band 4. Besides this, the grade pay should be revised to Rs 11,000.

    For the post of food inspector, the revised pay scale of Rs 9,300 –Rs 34,800 should be given approval, the recommendations state. It is further decided that the veterinary officer should be given Non-Practicing Allowance (NPA).

  • Gujarat Govt to revise daily wagers’ pay scale after 11 years
    In a bid to benefit nearly 19,000 daily wage earners working under various state government departments, the state Roads and Buildings Department (RBD) has decided to revise their monthly wages as per the norms laid down by the Sixth Pay Commission. The move has come 11 years after the last wage revision was undertaken in 1998.
    According to the revised wages, the workers who were under the pay-scale of Rs 2,550-3,200 will now fall in the pay-scale of Rs 4,440-7,448.

    They will get Rs 1,300 as Grade Pay.

    Similarly, those under the Rs 3,050-4,590 scale will now come under the revised pay scale of Rs 5,200-20,208, with Rs 1,900 as Grade Pay.

    Bharat Trivedi, Deputy Secretary, RBD, said, “This revision is applicable for workers who were getting salaries as per the provisions of the Fifth Pay Commission till now and their salaries were regularised before the cut- off date of October 17, 1988.”

    RBD officials said the pay revision would be operative from January 1, 2006 but the workers will get arrears in cash only for the period starting April 1, 2009. For the period between January 1, 2006 and March 31, 2009, the arrears would be deposited in their respective Provident Fund accounts over a period of five years, with 20 per cent contribution every year.

    Also, the workers will not be able to withdraw this sum before the completion of five years.

    Trivedi said that RBD alone employs almost 10,000 workers in various construction activities across the state, including highways, roads, canals and government buildings.

    “The remaining 9,000 workers set to benefit include those in the Narmada and Water Resources, Forest and Environment, Panchayats and Rural Housing as well as Agriculture and Cooperation Department,” he said.

  • 40% interim relief for Assam Govt employees
    The State Government employees are in an upbeat mood as they would be getting 40 per cent interim relief with effect from January 1 this year. With the announcement of the new interim relief, the difference between the pay scales of the Central and State Government employees also came down considerably. Talking to The Assam Tribune, secretary general of the Sadau Asom Karmachari Parishad (SAKP), Bashab Kalita said that they were satisfied with the decision of the Government.

    Kalita said that the State Government announced 15 percent interim relief with effect from April, 2008 and added 10 per cent more with effect from January 1 this year. However, because of the delay on the part of the State Pay Commission in submitting its report, the Chief Minister, Tarun Gogoi announced the Government’s decision to add 15 per cent more to the interim relief with effect from January 1 this year and to pay the arrears before the ensuing Durga Puja festival.

    The SAKP office bearer said that the differences between pay scales of the State and Central Governments would be reduced considerably after the state employees started receiving 40 per cent interim relief.

    Kalita said that the State pay Commission was scheduled to submit its report by the end of May, but it was given three months’ extension despite strong opposition from the employees. He said that the Commission was given extension for another month up to the end of September, which forced the SAKP to announce an agitational programme. However, the agitational programme has been withdrawn following the decision of the State Government to increase the interim relief to 40 per cent. The Chief Minister also assured the SAKP that no further extension would be given to the Pay Commission to submit its report.

    The SAKP has been demanding that the new pay scale should be given to the employees with effect from January, 2006 as was given to the Central Government employees. He also alleged that some of the teachers and other employees are yet to receive the arrears due to them for the period from January1, 1996 to July 31, 1998 and demanded that the Government should immediately look into the matter.

  • PCMA appeal to HRD minsiter for uniform implementaion of pay scales
    Punjab Commerce and Management Association (PCMA) have appealed to the Union Human Resources Development Minister Kapil Sibbal to intervene and ensure uniform implementation of MHRD recommended pay scales in all the states.

    Association members were pained by the distortions made by the bureaucracy while making the notification for the pay scales of college and university teachers in the state of Haryana.

    Association today written a letter to HRD Minister which states that notification issued by the Ministry of human resources development Government of India concerning the scheme of revision of pay of teachers and equivalent cadres in universities and colleges dated 31-12-2008 still hangs in balance as most of the state governments has not yet implemented it for the one reason or the another even after the passing of eight months. Letter further states that The most disturbing fact which is becoming roadblock in the implementation, is the delay in the notifying the UGC regulations on revision of pay scales, minimum qualifications for appointment of teachers in universities and colleges and other measures for the maintenance of standards, 2009.

    The University Grants Commission put a draft notification on its website for seeking suggestions on 18th February 2009, which was to be finalized after consultation with the stakeholders. The consultation process was completed till May 31st 2009 but still the draft regulations hangs in the sky and final regulations has still not been issued by the University Grants Commission. Secondly the draft regulation which was to be rectified because it exceeds in many respects the mandate of the UGC is still put on the website of the university commission which is causing confusion in implementation of MHRD Notification. Most of the state governments because of the Non-availability of the Final UGC regulations on the pay scales are keeping the promotions, upward movements, re-designations, etc. falling due on or after 1.1.2009 in abeyance.

    PCMA Further requested the HRD Minister to issue advisory to the state governments to not to dilute the provisions of MHRD Notification on Pay scales of college and university teachers issued on 31-12-2008 and keep the spirit behind it.
